Background

Through FOIA case 24-F-1138, the Department of Defense released the exact wording of the "Verbal Legal Advisement" presented to David Grusch and other witnesses during All-domain Anomaly Resolution Office (AARO) interviews. The document reveals the statutory framework allowing witnesses to disclose classified UAP information covered by NDAs and Special Access Programs.

The advisement explicitly states that within the Secure Compartmented Information Facility (SCIF), disclosures are "not subject to any Nondisclosure Agreement" signed by the witness, citing Section 1673 of the FY23 National Defense Authorization Act. However, it clarifies that all secrecy agreements resume full force immediately upon completion of the interview.

Witnesses are informed that participation is voluntary, that transcripts become government property subject to the Privacy Act, and that false statements may result in criminal prosecution under 18 U.S.C. § 1001 as well as jeopardize security clearances.
